When Is Rent Considered in Arrears?

Day 1: Send a text message reminder to the tenant.
Day 2: Send a second text message reminder if the rent remains unpaid.
Days 3-4: Call the tenant and follow up by text message and/or email.
Days 4-6: Continue phone, text and email follow-up, keep clear communication records, and check whether there is a genuine reason for the delay.
For general tenancies in Queensland, if the tenant falls more than 7 days behind in rent, the property manager or owner can issue a Notice to remedy breach, also known as Form 11. This gives the tenant 7 days to pay the outstanding rent. If arrears reach 6 days without a clear reason or payment arrangement, we also report the matter to the owner so they are kept informed before any formal notice is issued.
If the tenant pays the overdue rent within the required timeframe, the tenancy continues.
What Happens If the Rent Is Still Not Paid?
If the tenant does not pay the outstanding rent and the breach is not remedied, the next step may be to issue a Notice to leave, also known as Form 12 with the owner’s permission to issue this Form12.
If the tenant still does not leave by the required date, the matter may need to be taken to QCAT for an order to end the tenancy. The timeframe for a QCAT hearing can vary, so accurate records and correct notices are very important.
This is why rent arrears should be managed carefully from the beginning. Incorrect notices, missed dates, or poor record keeping can delay the process and create further risk for the property owner.
